1. Introduction and Agreement
These Terms of Service and Acceptable Use Policy ("Terms" or "Agreement") constitute the entire legal agreement between Mission Inbox Inc ("Company," "we," "us," or "our") and you ("User," "you," or "your") regarding your use of our email service platform and related services (collectively, the "Service").
By accessing, registering for, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Service Description
Our Service provides email delivery infrastructure designed to facilitate legitimate business communications, including valuable sales outreach. We maintain high deliverability standards through careful management of our sending reputation and enforcement of quality guidelines.
3. Account Registration and Management
3.1 Eligibility
You must be at least 18 years old to use our Service
You must provide accurate, complete, and current registration information
You represent that you have the legal authority to enter into this Agreement
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials
You must notify us immediately of any unauthorized use of your account
You are liable for all activities that occur under your account
3.3 Account Termination
We reserve the right to suspend or terminate your account immediately for:

Failure to pay applicable fees

4. Acceptable Use Policy
4.1 Philosophy: Quality Over Quantity
Like a reputable postal service that maintains its reliability by refusing to deliver suspicious packages, we maintain email deliverability by ensuring all messages meet quality standards. We support legitimate sales outreach while strictly prohibiting spam.
4.2 Deliverability Requirements
All users must maintain:
Complaint rate below 1% - Recipients marking your emails as spam
Bounce rate below 4% - Emails sent to invalid addresses
Unsubscribe compliance - Honor opt-out requests within 7 days
Exceeding these thresholds may result in immediate account suspension.
4.3 Permitted Sales Communications
We distinguish between valuable sales outreach and spam. Legitimate sales emails are permitted when they:
For Opt-in Recipients:
Are sent to recipients who have explicitly consented to receive communications
Provide clear value proposition relevant to the recipient
Include proper sender identification and contact information
Contain functional unsubscribe mechanisms
For Cold Outreach (Business-to-Business Only):
Target business email addresses (not personal accounts)
Are highly personalized and relevant to the recipient's business
Include clear explanation of why you're contacting them
Provide genuine business value or opportunity
Include easy opt-out method
Are sent in reasonable volumes (not mass blasts)
Comply with CAN-SPAM, GDPR, and applicable regulations
4.4 Prohibited Content and Activities
Strictly Forbidden:
Spam: Mass, non-personalized, unsolicited emails without clear business value
Phishing: Fraudulent emails attempting to steal information or credentials
Malware/Viruses: Any malicious code or harmful attachments
Illegal Activities: Content promoting or facilitating illegal activities
Harassment: Threatening, intimidating, or abusive communications
Deceptive Practices: False headers, misleading subject lines, or impersonation without written consent.
Prohibited Industries and Content:
Illegal goods or services
Adult/pornographic content
Pharmaceutical products without proper licensing
Gambling services
Multi-level marketing or pyramid schemes
Get-rich-quick schemes
Credit repair services
Payday loans
List brokers or email list rental
Social media engagement manipulation
Any content we determine harms our reputation or deliverability
4.5 Content Standards
All content must be truthful and non-deceptive
Subject lines must accurately reflect email content
Sender information must be authentic and verifiable
Unsubscribe requests must be honored promptly
Recipients must be able to identify you as the sender
4.6 Technical Restrictions
No attempting to circumvent rate limits or quotas
No creating multiple accounts to evade restrictions
No interfering with Service operations or other users
No reverse engineering or unauthorized access attempts
5. Billing and Payments
5.1 Hybrid Billing Model
Our service operates on a hybrid billing model comprising subscription and usage-based charges.
Billing Timing: Subscription fees are billed in advance; usage-based charges are billed in arrears at the end of each month
5.2 Payment Terms and Requirements
Base subscription payment is due in advance for each billing cycle
Usage-based charges are calculated monthly and billed along with your subscription renewal, but are considered separate charges.
Valid payment method required to maintain active service and process usage charges
Automatic renewal of subscription unless cancelled before the billing cycle ends
Important: Cancellation of subscription does not waive responsibility for outstanding usage-based charges incurred during the billing period
5.3 Usage-Based Billing Details
Mailboxes, Emails sent, and function credits are considered on the usage-based billing.
Usage charges are calculated from the first day of your subscription cycle.
Usage billing is final on the last day of your subscription cycle, and charges are due immediately
You remain liable for all usage charges even if you cancel your subscription mid-cycle
5.4 Fees and Pricing
Subscription and usage fees may be modified with reasonable advance notice
All usage-based fees are non-refundable except as required by law
No refunds for policy violations, partial usage, or mid-cycle cancellations
For subscription charges, a refund grace period of 2 days from the renewal date applies. After this grace period, subscription fees become non-refundable.
Unpaid usage charges may result in service suspension and collection efforts
5.3 Free Trials
Free trials may be offered at our discretion
Billing information may be required for trial activation
Automatic conversion to paid subscription unless cancelled
Trial terms may be modified or cancelled without notice
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of content you submit through the Service
You grant us a license to transmit, deliver, and store your content as necessary to provide the Service
You are solely responsible for the legality and appropriateness of your content
You warrant you have rights to all content you submit
6.2 Our Intellectual Property
The Service and its original content remain our exclusive property
Our trademarks may not be used without written consent
You may not copy, modify, or reverse engineer our Service
6.3 Copyright Protection
We respect intellectual property rights

Repeat infringers will have their accounts terminated

8. Service Availability and Modifications

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
10.3 Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

These Terms are governed by the laws of Delaware, United States of America, without regard to conflict of law principles.
11.2 Dispute Resolution
Disputes will be resolved through binding arbitration in Delaware, United States of America, except for claims that may be brought in small claims court.

If any provision is found unenforceable, the remaining Terms remain in full effect.
11.4 Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
11.5 Modifications
We may update these Terms by posting revised versions on our website. Continued use constitutes acceptance of changes.
